Please enroll my/our child/ren in Robert M. Beren Academy (the "School") for the academic year 2012-2013. In consideration thereof, the undersigned ("Parent") agrees to the terms contained in this Contract. "Parent" means parent(s), guardian(s) or person(s) responsible for payment of amounts due under this Contract as signed below. It should be understood that no child/ren may begin classes until this Contract is completed, signed and returned to the school along with the selected form of payment. Parent hereby agrees to comply with all policies, regulations and procedures of the School including any policies that are subsequently enacted or revised
The appropriate non-refundable tuition deposit indicated on the Tuition Fee schedule (payment-in-full or any remaining balance) must accompany this Contract. The deposit will not be refunded, unless failure to enroll is due to: (a) extended illness, (b) the family moving from the Houston area, (c) non-acceptance of enrollment by the School. In no event will the deposit be refunded if the student(s) attend(s) the School for any portion of the 2012-2013 school year.
Parent agrees to the tuition amount as indicated on the 2012-13 RMBA Tuition and Fees Schedule. The amounts assume full payment and do not reflect any subsequent agreements with School for financial scholarship. Amounts agreed with School for financial scholarship will supersede the amounts shown on the Tuition and Fees Schedule and all other terms and conditions of this Contract shall remain in force.
If Special Education or other fees are incurred (with the agreement of Parent) after this contract has been executed, the School will add these fees to the total contract amount and these fees will become a part of this contract and the FACTS payment agreement.
Payment in full can be made to the School by August 1, 2012. All other payment arrangements (Automatic Bank Drafts and/or Credit Cards) must be made through FACTS, as described below.
Automatic Bank Drafts will be handled by FACTS. Please enroll by going to e-Cashier on the Admission page of the school's website, www.berenacademy.org. Enroll one time only using your family name as your unique identifier .
Credit card payments will also handled by FACTS. Please enroll by calling 800-233-1096. You will need to know the school's ID numberŅ 03388, the Student ID (use your family name) and the balance due, in addition to the information concerning your credit card .
TUITION PAYMENT CONTRACT:
THE TUITION PAYMENT CONTRACT CONTAINED HEREIN WILL BECOME EFFECTIVE ON MAY 28, 2012, UNLESS PRIOR TO SUCH DATE THE SCHOOL CANCELS THE CONTRACT OR RECEIVES WRITTEN NOTICE FROM PARENT OF THEIR INTENTION TO TERMINATE THIS CONTRACT. IN THE EVENT OF SUCH TERMINATION PRIOR TO MAY 28, 2012, THE NON-REFUNDABLE DEPOSIT WILL NOT BE REFUNDED EXCEPT UNDER THE CIRCUMSTANCES DESCRIBED ABOVE. IF PARENT TERMINATES OR IS IN BREACH OF THIS CONTRACT AFTER MAY 28, 2012, THEN PARENT AGREES TO PAY TO THE SCHOOL LIQUIDATED DAMAGES OF $2,500 PER STUDENT (IN ADDITION TO NON-REFUNDABLE DEPOSIT). THE LIQUIDATED DAMAGES PROVISION IS DESIGNED TO REFLECT, AMONG OTHER THINGS, THE COSTS ASSOCIATED WITH THE SCHOOL'S COMMITMENT TO PROVIDE RESOURCES FOR EACH STUDENT.
DELINQUENT ACCOUNTS. Timely payment of tuition in accordance with this Contract and of all other School fees is important to the operating budget of the School. Parent therefore agrees that any returning student for whom tuition or other School charges are delinquent as of July 31, 2012, will not be enrolled for the 2012-2013 school year.
FULL YEAR OBLIGATION. Parent agrees that Parent will pay the full amount required by this Contract for the entire School year, without rebate for the student's withdrawing prior to the end of the School year. Notwithstanding, a prorated tuition rebate will be granted by the School if withdrawal from the School is the result of (i) extended illness of the student(s), (ii) move from the Houston area of the student(s), (iii) request by the School that the student(s) withdraw. Except as specifically set forth above, Parent's obligation to pay the tuition for the entire School year shall not be reduced, diminished or abated by reason of Parent's selection of payment schedule.
SCHOOL'S RIGHT RESERVED. The school reserves the right (i) to insist upon the immediate withdrawal during the school year of any student whose presence is considered by the School to be detrimental either to the student's or the School's best interest, or who in effort, conduct, or progress is not fulfilling the School's expectation (ii) to elect, at the School's sole discretion, not to accept for any reason an application on behalf of the above named student(s) for enrollment in the School for any School year and (iii) to amend any term or provision of this Contract by written Contract with the undersigned, or to amend any term or provision of any similar Contract with any other party by written Contract with such party, all based upon such individual considerations and factors as the School may deem relevant, as to financial condition or otherwise. No amendment made by the School with any other person shall affect this Contract between the School and the undersigned. The School reserves the right to dismiss any Student who does not comply with the rules and regulations of the Parent/Student Handbook including any changes or revisions to the Parent/Student Handbook as adopted by the School.. This Contract creates no expectancy of re-enrollment for future school years.
Parent agrees that if any student's account under this contract becomes delinquent, 1) the School will not release student's (students') progress reports, teacher evaluations, grades, transcripts and/or diplomas or certificates of graduation, 2) the School will not issue an enrollment contract for the following year, 3) the student(s) may be excluded from attendance until all such accounts are current, and 4) the enrollment of the student(s) may be terminated without affecting the full year's obligation for tuition and fees under this Contract. If any such enrollment contract for the following year has been issued and the current year's account for student(s) becomes delinquent, the School reserves the right to revoke the contract. In the event that the School initiates legal action to collect amounts due on this contract Parent agrees to pay the School's cost of collection, including legal fees. For purposes of this contract "delinquency" means more than 10 days past due date for any payment due School. All progress reports, teacher evaluations, transcripts and/or diplomas or certificates of graduation shall remain the property of the School at all times. The parent agrees that the School is under no obligation to mitigate its damages under this contract, and that any subsequent enrollment by any other student will not relieve the Parent of his/her/their monetary obligations under this Contract. Parent further agrees to pay liquidated damages in the amount of all tuition and fees owed for the full academic year plus costs of collection, including legal fees, in the event of a breach of this Contract, less any payments made by Parent under this Contract. Parent further agrees that this liquidated damage provision is not a penalty, but a reasonable assessment of the School's damages in the event of a breach of this Contract.
Parent agrees that this Contract is between Parent and the School and is not contingent upon the assignment of the Student to any particular teacher. The School reserves the unconditional right to suspend or dismiss any student whose progress or conduct is considered by the School to be unsatisfactory or for any other reason outlined in the Parent/Student Handbook or any other policy of the School.
Parent agrees to comply with and be subject to the terms and conditions of the Parent/Student Handbook as amended from time to time. Parent further agrees that the School's tuition and fee schedule are a part of this Contract. Parent understands that this is a binding contract, and may be changed only in writing, signed by the School.
Parent agrees to permit the School to use, in whole or in part, photographs, videos, written extractions and voice recordings of my student for the purpose of illustrations, publications, and websites.
Parent acknowledges that this Contract and the documents made a part of this Contract represent the complete Contract between School and Parent and supersedes any prior Contract(s), written or oral.
The School reserves the right not to continue enrollment or not to re-enroll Student(s) if the School concludes that actions of Parent interfere with the School's accomplishment of its educational purposes.
By signing this Contract, Parent acknowledges that (s)he has read all terms of this Contract and agrees to abide by these terms, including the Tuition and Fee Schedule and Parent/Student Handbook. Parent agrees to abide by the regulations and procedures of the School and agrees to fully cooperate with administrators and teachers of the School.
SERVICES TO BE RENDERED. The services to be rendered in connection with this Contract are educational services. The School makes no specific representations or warranties regarding the ability of any student to reach certain achievement goals or otherwise gain acceptance into particular colleges or other programs.
BINDING EFFECT OF THIS CONTRACT. This Contract shall not become binding upon the School or the undersigned until the fully executed original of the Contract has been received by the School.
MULTIPLE CHILD DISCOUNT, This is offered only to families not applying for financial aid. The eldest three children pay full tuition. Subsequent children, in descending grade order, will each receive a 25% tuition discount.
FINANCIAL AID. FACTS Grant & Aid Assessment will be conducting the financial need process for RMBA for the upcoming 2012-2013 school year. Families applying for financial aid will need to complete an application and submit the necessary supporting documentation to FACTS Grant & Aid Assessment. The School reserves the right, at it its sole discretion, to change the amount of any financial aid award at any time during the tenure of this tuition contract (lowering the amount of financial aid offered or eliminating the award in total). Changes could result from, but are not limited to, a change in the recipient family's financial condition or an act by the recipient family deemed by the School to be detrimental to the School.
GOVERNING LAW.
THIS CONTRACT SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS.
By signing this Contract, the student and Parent agree to the rules, policies, and regulations of the School as well as the terms of the Contract.
